Local Zoning, Safety, and Occupancy
Before applying to the State or the Board, you must ensure your property is legally allowed to operate as a residential facility.
1) Zoning Verification:
- You must obtain a Zoning Verification Letter from the Hamilton County Planning + Development Department or your specific city/township. Do not assume standard “residential” zoning covers group housing.
- Exceeding a certain number of unrelated adults often triggers a “Change of Use” in the building code.
2) Building & Fire Safety:
- You must secure a Certificate of Occupancy for the intended number of residents from the Hamilton County Building Department and pass a State Fire Marshal Inspection.
